Effective Date: June 4, 2026
By accepting an estimate, proposal, or invoice from MBA Scapes, LLC ("Company"), the customer agrees to the following terms and conditions.
Services will be performed as described in the approved estimate or proposal. Any additional work requested by the customer outside the original scope may require a written change order and may result in additional charges.
Unless otherwise stated, estimates are valid for thirty (30) days from the date issued. Material pricing and availability are subject to change if work is delayed beyond this period.
Payment is due upon completion of work unless otherwise agreed in writing. Invoices unpaid after fifteen (15) days may accrue a late charge of 1.5% per month or the maximum amount permitted by law.
The customer is responsible for providing reasonable access to the work area. Locked gates, pets, vehicles, or other obstructions may result in delays or additional charges.
MBA Scapes, LLC will request public utility locates when required. Customers are responsible for identifying private irrigation systems, landscape lighting, invisible fences, private utilities, and other underground improvements. The Company is not responsible for damage to undisclosed or non-visible private installations.
Project schedules may be affected by weather, material shortages, or unforeseen site conditions. Hidden obstacles or unknown utilities may require additional work and pricing adjustments.
MBA Scapes, LLC provides a one (1) year workmanship warranty covering defects directly resulting from its installation methods. This warranty excludes normal settling, extraordinary weather events, acts of God, improper maintenance, third-party damage, alterations, and ordinary wear and tear. Manufacturer warranties are passed through to the customer when applicable.
The Company is not responsible for damage resulting from drought, disease, insects, pre-existing conditions, or environmental factors beyond its control.
Any claim for property damage must be reported within seventy-two (72) hours of service completion.
Special-order materials, permits, or costs already incurred on behalf of the customer may be non-refundable.
The Company may take project photographs for documentation and marketing purposes. No personally identifiable customer information will be published without permission.
To the fullest extent permitted by law, the Company's total liability shall not exceed the amount paid for the specific services giving rise to the claim.
These Terms and Conditions shall be governed by the laws of the State of Colorado.
